Privacy Policy
1. Introduction
Through the services of MOOS B.V. (hereinafter: 'MOOS' or 'we'), privacy-sensitive data (hereinafter: 'personal data' or 'data') is processed. By processing we mean any use of your personal data, such as storing, modifying, forwarding or (partially) deleting it. We process personal data because you use our services. The data controller is MOOS, located at Archangelkade 47, 1013BE Amsterdam, the Netherlands. Questions about privacy can be sent to info@moosamsterdam.nl or asked by phone at +31 6 23 65 80 78.
We believe it is important that your data is handled with care, and we make sure the personal information you provide is treated confidentially. In this statement we explain which personal data we collect, why we collect it and what we do with it.
2. Why do we process personal data?
We only use your data for clear, predefined purposes. For MOOS, these are:
- Delivering our services: we need your data to carry out the engagements we have agreed with you, such as compiling annual accounts, preparing tax returns or providing financial advice.
- Complying with legal obligations: as an accounting firm we are subject to strict legislation. We process data to comply with, among others, the Dutch Anti-Money Laundering and Anti-Terrorist Financing Act (Wwft), tax legislation and our professional rules (NBA).
- Payroll administration: if you use this service, we (together with our specialised partner) process data of your employees to prepare payslips and payroll tax payments correctly.
- Relationship management and communication: to stay in touch with you about our services or to respond to questions you ask by email or phone.
We never use your data for other purposes without first asking your consent again or having a legal basis to do so.
3. What data do we collect?
We may use the following data for the purposes described in this statement:
- First and last name
- Gender
- Date of birth
- Place of birth
- Address details
- Phone number
- Email address
- Payment details, such as billing address, bank account number and, where applicable, credit card details
- Citizen service number (BSN)
- Financial data, income data and other data about your financial situation
To prepare tax returns and benefit applications, various other applications and payroll administration, MOOS is legally required to process the citizen service number (BSN). A full copy of your identity document is also required for payroll tax purposes. The Wwft (Dutch Anti-Money Laundering and Anti-Terrorist Financing Act) requires MOOS to verify your identity and keep proof of it.
Confidentiality and non-disclosure to third parties are the guiding principles here. This of course also applies to login details such as usernames and passwords. Our technical and organisational security measures are designed accordingly.
We do not process data about, for example, race, political opinions, religious beliefs or medical information. Should there be a specific reason to do so, we will include this explicitly with you in the service agreement.
4. How do we obtain personal data?
The main way we obtain data is by asking you for it. You decide whether or not to provide this data to us, for example the details you can fill in yourself on our website. For some (additional) services, certain data must be provided before you can use those services.
5. How long do we keep personal data?
We aim not to keep personal data longer than necessary for the purpose of the processing. There is no single retention period that applies to all types of data. We keep your data at least for as long as you use our services and will delete it within a reasonable time once the purpose has lapsed. The exception is when the law requires us to keep certain data for longer. For example, the Dutch General Tax Act (Algemene wet inzake rijksbelastingen) requires us to keep payment data for 7 years for the Tax Administration.
6. Do we share personal data with third parties?
In some cases we use third parties to process your personal data, which may give them access to your data. Where possible, we require these third parties to act as processors. This means that we determine the purpose and means of the processing and that the processor may only handle your data in accordance with our instructions and our (security) standards. We record these agreements with each processor in a data processing agreement.
In addition, we will only share personal data with third parties if we have your consent or if we are required to do so by law.
7. What are your rights as a data subject?
You have the right to access, correct, port or have your personal data deleted. You also have the right to object to the processing. Finally, we would like to point out your right to file a complaint with the Dutch Data Protection Authority (Autoriteit Persoonsgegevens).
You can ask us at any time to access, correct or delete your data by sending an email to info@moosamsterdam.nl. Please specify as precisely as possible which personal data your request concerns and, where possible, prove that it is your personal data. We will respond to your request as soon as possible.
8. How do we protect personal data?
MOOS takes the protection of your data seriously and takes appropriate measures to prevent misuse, loss, unauthorised access, unwanted disclosure and unauthorised modification. If you feel your data is not properly secured or there are indications of misuse, please contact us at info@moosamsterdam.nl.
Clients, employees, sub-processors and third parties can report incidents that may cause a data breach via info@moosamsterdam.nl. MOOS investigates reports as soon as possible and takes the measures needed to prevent further harm to those involved and to MOOS. As required by law, a data breach that may have serious consequences is reported to the Dutch Data Protection Authority and to the person(s) whose personal data is involved.
9. What cookies does our website use?
MOOS does not use cookies or similar technologies on its website. We therefore do not collect data from website visitors for marketing purposes or to track browsing behaviour.
10. How can you contact us?
If you have questions, comments or complaints about the way we handle your personal data, please contact us at info@moosamsterdam.nl. You can also reach us by phone at +31 6 23 65 80 78.
11. Changes to this privacy statement
We may unilaterally amend this privacy statement from time to time. We therefore recommend that you check this statement regularly for changes. If we make significant changes, we will inform you in an appropriate manner, for example by email or by asking for your consent again.
